TERMS OF SERVICE

These Terms and Conditions of Service apply to customers who consult, book, or purchase building electrical installation, smart cabling, and related construction services provided by Jerome ETIENNE through this website.

  1. Nature of Services

Jerome ETIENNE provides electrical installation, smart cabling, and related construction services for commercial and residential buildings.

All services are one-off services arranged according to the specific project needs of the client. Unless otherwise expressly agreed in writing by both parties, services will not automatically renew upon completion and do not constitute a continuing service contract.

  1. One-off Services and Refund Policy

All confirmed and arranged services are one-off services.

Due to the personnel arrangements, on-site construction, project planning, and potential material and other costs involved in electrical installation, cabling, and related professional services, refunds are not supported for completed services.

For confirmed but not yet started services, customers who need to cancel or reschedule should contact us as soon as possible. Any cancellation, postponement, or related fee handling shall be subject to the quotation, contract, or project agreement confirmed by both parties.

Where applicable law provides for an inalienable refund or other legal right of the client, this clause shall not restrict or exclude such legal rights.

  1. Quotation and Payment

Specific service prices, scope of work, and payment arrangements shall be subject to the quotation, contract, or written project agreement confirmed by both parties.

Unless otherwise agreed in writing by both parties:

The client shall pay service fees according to the agreed payment schedule;
For large projects, payments may be made in installments according to project phases;
Confirmed costs of materials, equipment, and other items may require payment before commencement of work;
The client shall not withhold payment for completed services without reasonable grounds.

If the client fails to make payments as agreed, Jerome ETIENNE may, to the extent permitted by law, suspend uncompleted services until the outstanding payments are settled.

  1. Project Scope

Services include only the scope of work confirmed by both parties.

If the client requests additions, modifications, or expansions to the scope of work during the project, additional work may incur additional costs and changes to the project timeline. Any significant changes must be confirmed by both parties before implementation.

  1. Intellectual Property

Unless otherwise agreed in writing, Jerome ETIENNE owns or legally enjoys the intellectual property rights to all text, graphics, technical data, solution documents, photographs, brand content, and other original materials on this website that it has created or provided.

Without Jerome ETIENNE’s prior written permission, the client may not copy, sell, republish, modify, or use them for commercial purposes unrelated to Jerome ETIENNE’s business.

The intellectual property rights of drawings, designs, photographs, and other materials provided by the client to Jerome ETIENNE remain with the client or the original rights holder. The client shall ensure that it has the right to provide and permit us to use the relevant materials for project purposes.

  1. Website Content

This website is used to introduce Jerome ETIENNE’s services and business information.

The service descriptions, photographs, project cases, and other materials on this website are for general reference only. The specific technical requirements, scope of work, price, and construction period of a project shall be subject to the project documents formally confirmed by both parties.

  1. Limitation of Liability

To the maximum extent permitted by applicable law, Jerome ETIENNE shall not be liable for any indirect, special, or consequential damages arising from:

Inaccurate information or materials provided by the client;
Material discrepancies between site conditions and information provided by the client;
Delays or damages caused by other contractors or third parties;
Events beyond our reasonable control;
Unauthorized modification, removal, or interference with completed installations by the client;
Losses arising from normal use, third-party equipment malfunction, or other causes not directly caused by us.

This Agreement does not exclude or limit liability that cannot be excluded or limited by law, including personal injury or death caused by our negligence, and other liabilities that cannot be excluded by applicable law.

To the extent permitted by applicable law, for any direct damages, our liability shall be limited to the contract amount for the relevant services or other limits permitted by applicable law.

  1. Customer Responsibilities

The customer shall:

Provide accurate and truthful project and contact information;

Ensure we can reasonably enter the construction site within the agreed timeframe;

Inform the customer of known structural, wiring, and site safety risks;

Obtain the necessary permits or owner authorization before construction;

Pay the relevant fees on time.

Failure by the customer to provide the necessary site conditions may result in construction delays or additional costs.

  1. Force Majeure

We shall not be liable for delays or inability to perform services caused by events beyond Jerome ETIENNE’s reasonable control.

Such events may include severe weather, fire, flood, government measures, supply chain disruptions, major equipment failures, labor shortages, or other events that are not reasonably foreseeable or controllable.

  1. Dispute Resolution

In the event of a dispute between the customer and Jerome ETIENNE, both parties should first attempt to resolve the matter amicably through direct communication.

If the dispute cannot be resolved through negotiation or mediation, the parties may consider the following methods as appropriate:

Negotiation – Direct communication and attempts to reach a solution between the parties; Mediation – With the mutual consent of both parties, an independent third party may assist in resolving the dispute; Court proceedings – If the dispute cannot be resolved through negotiation or mediation, either party may bring suit in a court of competent jurisdiction under applicable law.

We encourage both parties to first attempt to resolve the dispute reasonably and promptly before initiating formal legal proceedings.

  1. Applicable Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.

To the extent permitted by applicable law, any dispute arising from these Terms and Conditions or related services shall be settled in a court of competent jurisdiction in England and Wales.

If mandatory laws stipulate that consumer protection laws or other laws apply in the customer’s place of residence, such mandatory rights shall not be excluded by these Terms and Conditions.

  1. Amendments to Terms and Conditions

Jerome ETIENNE may update these Terms and Conditions in accordance with changes in business, services, or laws and regulations.

For confirmed projects, unless required by law or otherwise agreed by the parties, the specific service conditions of the project shall remain as per the confirmed quotation, contract, or project agreement.
